Path to be diverted

A PUBLIC footpath in Hanging Heaton looks set to be diverted.
Mr R Hemmingway of Nursery Wood Road has asked Kirklees Council to consider moving the route of the path, known as Batley 35.

At the moment the footpath cuts through the land surrounding Mr Hemmingway’s house.

He hopes the council can move it o
nto land owned by Savile Estates instead so it is no longer within the curtilage of his property, and permission has been gained from the estate to do this.

Mr Hemmingway thought the footpath had been diverted when his home was built in the early 1960s.

The Open Spaces Society has no objection to the diversion route as people already used it, belieiving it to be the public right of way anyway.

But council officers said the proposed route was not accessible until clearance by Savile Estate in May 2008 as it was covered with dense vegetation, overhanging trees, rubbish and rubble.

Coun Mary Harkin (Lab, Batley East) is supporting the application. There have not been any objections.

The decision is due to be made by the Planning and Highways Committee on Monday at 10am at Dewsbury Town Hall.

If the order is made to change the route, there will be a statutory 28 day notice period during which time the public can object.
