Hours not extended

A FAST-FOOD takeaway which was breaching its licenced hours by staying open until late at night has been told it must close at 8pm.

Steak & Shake Limited in Howard Street applied to Kirklees Council to extend its hours to 11pm to cope with nearby competition, but was already staying open until late, a meeting heard.

Council officers from the night time noise team said they had witnessed activity at Steak & Shake as late as 11.45pm.

People living near the takeaway had complained to the council about noise and smells coming from it.

They also complained about the increase in traffic it had caused, and customers shouting from their cars and leaving their engines running.

Speaking at a Heavy Woollen planning sub-committee meeting on Thursday, the takeaway’s agent, Robert Halstead, said: “Operators have to run a business and the difficulty for them is that there is competition all around which stays open until 11pm. They are struggling, or will struggle, to make a living if they are operating a business which closes at 8pm.”

Councillors on the sub-committee heard the takeaway had also failed to improve its flue system, which was a condition when planning permission was originally granted earlier this year.

The sub-committee heard the takeaway’s breach of conditions was currently being investigated, and an enforcement notice had been served on its owners.

Coun Andrew Pinnock (Lib Dem, Cleckheaton) said Steak & Shake’s owners should have known its opening hours when it originally applied for permission to open.

He said: “The hours that he applied for in April were ones that he could have made a business out of.

“Conditions are imposed by the planning authority for a good reason.”
The sub-committee refused the application for a three month period, during which it said Steak & Shake should abide by its conditions and then reapply for permission to open until 11pm.
