Yobs jailed for head stamp attack

TWO yobs kicked a man unconscious and threatened to set fire to him – then laughed when they thought they had killed him.

Jamil Ellahi, 21, and Umar Hussain, 20, were seen kicking the Lithuanian man and Ellahi was seen jumping on his head in an attack a witness described as ‘brutal’.

The victim had been drinking at home with friends and had gone out to buy more when he was jumped on by the defendants, at 11.30pm on April 26 last year.

Prosecutor Simon Batiste said: “The next thing he remembers is waking up in hospital.”

A neighbour at Bradbury Street, Ravensthorpe, looked out after hearing noises and saw the attack. He rang the police as Hussain walked off, but Ellahi continued kicking the man, who was moaning. Ellahi got on his knees and started punching him, and the victim stopped moaning.

Hussain came back and said ‘you’ve killed him’, before the drunken pair walked off laughing.

Mr Batiste said the victim was heard moaning again, and the defendants returned, dragging the man down the ginnel.

Ellahi went through his pockets and one of the defendants was heard saying, ‘have you got a lighter, I’m going to set fire to you’.

Police arrived and found the victim drifting in and out of consciousness.

Ellahi, of Clarkson Street, Ravensthorpe, and Hussain, of Field Lane, Ravensthorpe, were found and arrested.

Ellahi told police the attack was self-defence, and also because he didn’t like paedophiles. But the court heard there was no question the defendant was a paedophile. He later said he couldn’t remember making the comments.

The victim was treated in hospital. Both defendants pleaded guilty to wounding.

Mitigating for Ellahi, Samuel Andrews said: “This is a nasty, unpleasant offence but it is very much out of character. He expresses a degree of remorse. He feels like an animal behaving so badly towards this man.”

Mitigating for Hussain, Martin Sharpe said his client had turned to drink after a family tragedy.

He said: “He is a caring and considerate young man. He has stopped drinking and he is working at his uncle’s off-licence. He would like to meet the victim to apologise. He is deeply ashamed.”

Judge Alistair McCallum said he was shocked the victim’s injuries had not been life threatening.

He said: “This was an attack in the street on a man who was clearly drunk. Why you attacked him, and why you attacked him with such violence, is beyond me.”

Ellahi was jailed for eight months, and Hussain was jailed for four months.
